General conditions for rental villas :
GENERAL
1/ WHAT THE PRICE INCLUDES :
Information requests before your arrival, your arrival in the villa: check-in, welcome by our staff, the price of the night in the selected villa, the provision of our concierge service.
2/ NOT INCLUDED IN PRICE:
Extras (cook, cleaning lady, driver etc), tips.
As an indication, here are the different prices of our services offered by the concierge service (list of services not exhaustive):
- Housekeeper
- Cook at home
- Deliver food to your villa, price according to the menu/dishes
- Driver price depending on need
- Nanny
- Care & Massage at home price according to services
- Car rental price according to rental car
- Activities / excursions price according to services
All "extra" services are to be paid at the end of the stay
3/ BOOKING CONDITIONS
Reservation of a villa is only available for a minimum of 3 nights in low season, and 7 nights in high season.
The access to the villa is only authorized to the persons included in the reservation.
A deposit of 30% is required to confirm the reservation of the stay, either by bank transfer, paypal or cash. PALM AGENCY reserves the right to cancel any reservation for which the deposit has not been paid in advance.
The remaining balance of the stay must be paid before or on the day of arrival of the clients. The non-payment of the balance immediately leads to the cancellation of the stay, the deposit not being refundable, except in the case of an emergency as stipulated below.
4 / CANCELLATION or DESISTING OF THE RENTERThe withdrawal or cancellation by the Client (tenant) will result in the immediate cancellation of his stay. No refund of the deposit will be made.
If the tenant cancels or withdraws less than one month before the start of the rental period, he/she will have to pay the difference between the deposit and the equivalent of the total rent, as compensation to the rental agency.
In case of restrictions related to the health crisis "COVID19" (confinement, closure of borders, flight cancellation) the deposit is kept for a later stay according to the availability of the villa, and this for one year. After this period, the tenant can request a refund from PALM AGENCY.
5/ CANCELLATION OF STAY BY PALM AGENCY
For any reason (extremely damaged villa following a fire, water damage, natural accidents), and if PALM AGENCY does not have any other villa similar to the one planned for the rental to replace the reserved villa, we reserve the right to cancel the stay, giving rise of course to the full refund of the sums paid for the reservation. PALM AGENCY will do its best to avoid the cancellation of the stay by proposing one or more alternatives to the tenant.
6/ CONDITIONS OF STAY
Arrival times are normally scheduled from 2pm (flexible hours), and departure times are scheduled before 11am (flexible hours)
If a delay of more than 4 days of the tenant in the villa is confirmed, and that this last one did not inform PALM AGENCY beforehand, we reserve ourselves the right to "re-rent" the villa while preserving the faculty to turn over us against the tenant.
The villa reserved must be occupied on a personal basis, and the tenants are obliged to occupy and maintain it "as a good father of family". Each occupant is obliged to respect all the internal regulations posted in the villa:
All guests and visitors must comply with the house rules and any other instructions provided by the property manager, during their stay; and guests must inform the property manager of any incidents or complaints from the neighborhood as soon as possible.
NOISE AND NEIGHBORHOOD
Travelers are entirely responsible for the safety of their children and any disturbance to the neighborhood and must keep noise to a minimum so as not to disturb the residents of neighboring villas, especially during the night from 11:00 pm to 8:00 am.
VISITORS
The reception of external persons not foreseen in the reservation, is not authorized in the villa.
Failure to comply with these rules will result in the immediate termination of the stay, the call of the police and the platform in charge of the rental. The rental managers are responsible for ensuring that the maximum number of travelers allowed is not exceeded.
PARTIES AND EVENTS
It is strictly forbidden to organize parties or any other type of large-scale gathering in the villas and any small gathering must be done in compliance with the other rules stipulated, in particular with regard to noise, neighborhood and the number of authorized visitors.
SECURITY
Each time Travelers leave the villa, they are required to ensure that all windows and doors are closed and/or locked to preserve the security of the accommodation and to prevent potential rain damage. Travelers must turn off lights, air conditioning, and electronic devices (televisions, computers, etc.) when not in use to conserve energy. The hosts and rental managers are not responsible for theft of personal belongings.
JACUZZI / HAMMAM / POOL
The use of the jacuzzi and steam room must be requested from the rental manager for safety reasons and the use of glasses is prohibited in the pool. Travelers must supervise babies and children at all times while using the pool or terrace. The hosts and rental managers are not responsible for any incident.
PARKING
Guests and travelers must comply with parking regulations and are asked to show consideration for neighbors and other vehicles.
SMOKING / CHICHA / ALCOHOL
Travelers are not allowed to smoke inside the villas managed by PALM AGENCY and must dispose of their cigarette butts properly and must not throw them in the garden of the property under any circumstances.
The consumption of alcoholic beverages is not tolerated in the villas.
PETS
Pets are not allowed inside the villas managed by PALM AGENCY.
BREAKAGE AND DAMAGE
Any broken object and/or damage caused must be reported to the property manager as soon as possible. Failure to do so may result in a deduction from the security deposit. To avoid breakage and damage, furniture should not be moved from one room to another without prior agreement. Please also note that towels must not leave the property, not to walk with shoes on the carpets of the villa and to take care of the equipment, televisions and appliances provided.
CHECK IN / CHECK OUT
The check-in and handing over of the keys is done from 2:00 pm with the villa manager (passports will be requested for security reasons). The check-out and inventory of fixtures must be done before 11:00 am and at least one hour before departure.
RESPECT OF THE RULES
Violation of any of the rules included in these rules constitutes a violation of the General Conditions of Occupancy, as per the rental agreement. The owner and manager reserve the right to terminate the occupancy permit and evict from the vacation rental property any visitor who refuses to abide by the rules and regulations or causes a disturbance to neighbors or other residents of the community.

A joint inventory of fixtures and an inventory will be established at the beginning and end of the stay.
A deposit check of 1 000 € must be given the day of arrival, and will not be cashed. PALM AGENCY will return the deposit after the stay, and reserves the right to claim a certain amount from the occupants if the tenants have caused damage in the reserved villa, and this under charges and or repairs.
7/ LIABILITY
PALM AGENCY and its staff decline all responsibility concerning incidents/accidents and their direct or indirect consequences, which may occur to the goods and/or persons present in the villa, and or in the subdivision of the rented villa. Their responsibility will not be sought under any circumstances.
PALM AGENCY expressly informs the clients, occupants and guests that the swimming pools of the rented villa, the children's games, the grounds such as tennis, soccer, basketball, petanque etc., are not subject to any surveillance.
PALM AGENCY advises and strongly recommends the utmost vigilance regarding the use of the swimming pools and outdoor materials by children. Children are under the sole and entire responsibility of their parents or legal guardians, or any other person occupying the premises, who are responsible for their care. The client/occupants shall not allow children to use the swimming pools or playgrounds alone and assume all responsibility in this regard.
Similarly, PALM AGENCY, nor the housing estate of the rented villa can be held responsible in case of interruption or failure of services such as water, electricity, gas. Personal belongings are under the sole responsibility of the clients/occupants.
Safety deposit boxes are provided in each villa to protect valuable personal belongings. Should PALM AGENCY be held responsible for a liability following a final court decision, the amount of the compensation cannot exceed the total cost of the rental paid by the client.
8/ ACCESS TO THE COMMON AREAS OF THE ALLOTMENT
It is advisable to contact the person in charge of the housing estate and to refer to the internal regulations in force for the housing estate.
9/ GUESTS
The allotment benefits from a guard day and night, 7 days a week and 24 hours a day. Only the owners and tenants mentioned in the reservation contract have permanent access. Exceptionally, and after acceptance of the person in charge of the concierge, the customers must obligatorily announce to the person in charge of the allotment, all the people whom they would like to invite, at the latest the day before their arrival. The complete identity of the guests will be requested and can be verified. The person in charge of the allotment as well as the guard are entitled to refuse the entry to any guest, without having to justify it, even if the acceptance would have been obtained beforehand. The internal rules of the allotment are applicable to the guests. The arrival of visitors is authorized until 10 p.m., then access is forbidden for security reasons.
10/ CONTRACT CANCELLATION
The signature of the contract at the moment of the reservation involves the client, as well as all the occupants who will stay in the villa, the full acceptance of all the general conditions as well as the conditions of the house rules, which are an integral part of the rental contract. The non-respect of these conditions may lead to an immediate termination of the rental contract, by full right and without indemnity. The clients, occupants and guests will have to leave the rented villa within two hours following the notification by the concierge.
11/ LEGAL ISSUES & JURISDICTIONS
In case of dispute concerning the execution of the present conditions, and that this dispute could not be settled by mutual agreement between the two parties, the competent courts of Marrakech (Morocco) will have exclusive jurisdiction.
